Recommendation:

The Planning Commission recommended approval on 7/5/17 by a vote of 4-0.

 

Staff recommends approval of the rezoning Ordinance RO17-0001 with proffers dated 3/17/17 and last revised 5/30/17.

Summary:
The applicant requests the rezoning of 2.05 acres from Office 1 (O-1) to Commercial 2 (C-2) and the rezoning of 1.26 acres from Rural (RU) to Commercial 2 (C-2), with proffers to allow certain uses permitted in the C-2 zoning district. The four parcels lie at the NW corner of the intersection of Plank Rd. (Route 3) and Spotswood Furnace Rd. 

The site is partially within the County’s Highway Corridor Overlay District.  The Comprehensive Plan identifies the property as within the Primary Development Boundary and the Future Land Use Map identifies this area for Commercial Land Use and Employment Center Land Use.  Tax Parcels 12B-A-3, 12B-3-A, 12B-A-6, and 12B-A-5. Courtland Voting District.

Financial Impact:
If this rezoning is approved, a positive financial impact is expected due to increased real estate tax revenue.  Additional positive financial impacts are expected should the companion Special Use Permit be approved due to increased sales and prepared food taxes.

Additional Background/Other Considerations:

The applicant has also submitted a concurrent Special Use Permit application to allow a Fuel Dispensing Service in a C-2 zoning district, in conjunction with a by-right Convenience Store, in order to operate a Sheetz gas station on the site.

 

The proffer statement attached has been approved to form by the County Attorney's office. 

Consequence of Denial/Inaction:
The properties will remain zoned as they presently are and the companion Special Use Permit request will become mute.
