Recommendation:
Approve the proposed updates to the Procurement Policy.

Staff is requesting approval of recommended updates to the Procurement Policy, including legislative updates and improvements to enhance the policy and further they are requesting the Board adopt the Resolution to place the updated Procurement Policy into effect.

 


Summary:

The Procurement Policy was last updated on December 13, 2016.  The current edits include both 2017 legislation updates and recommended edits by staff to improve and enhance the policy.

 

Attached are two versions of the proposed Procurement Policy.    The first version includes track changes, detailing the proposed edits.  The second version is a clean copy.  The proposed updates have been approved by the County Attorney’s office.

Additional Background/Other Considerations:

An additional Exception to Competition was added to the policy, Section 2-9 (t), at the request of the County Attorney’s Office after the updates were presented to the Finance Committee on September 21, 2017.  The additional exception is as follows:

 

(t)  An entity that is constructing road improvements pursuant to a proffered zoning condition or special exception condition in order to expand the scope of the road improvements in accordance with Section §15.2-2303.2 (C) of the Code of Virginia.

 


Consequence of Denial/Inaction:
Procurement Policy will not be updated with current legislation and the County will not be in compliance with current State procurement laws.
