Recommendation:
Staff recommends that the Board of Supervisors provide notice for thirty (30) days to determine if a public necessity exists for the 0.3 mile unpaved portion of Mallard Road to remain in the State Secondary System of State Highways.

Campers Inn requests that the County begin the abandonment process for the final 0.3 miles of Mallard Road, which is unpaved. The process includes a thirty (30) day period of public notice. If an adjacent property owner petitions a public hearing will be held. Otherwise, the Board may determine that no public necessity exists for the right-of-way and forward a recommendation of abandonment to VDOT.
Summary:
Jeff Hirsh, CEO of Campers Inn, requests that the County consider recommending the abandonment of the unpaved portion of Mallard Road. Planning staff and representatives of the Virginia Department of Transportation (VDOT) conducted inspections of the 0.3 mile long gravel/dirt portion of Mallard Road located in the Berkeley Voting District and researched the adjacent properties, which are all owned by CI Thornburg, LLC (Campers Inn). It does not appear that this portion of unimproved road serves benefit to the transportation network or any adjacent properties besides the applicant. The applicant proposes to cul de sac Mallard Road at the beginning of their property. The abandonment process includes a thirty (30) day period of notice. If an adjacent property owner submits a petition, a public hearing will be held. Otherwise, the Board may pass a resolution requesting that VDOT abandon the right-of-way.
