Recommendation:
Staff recommends that the Board adopt the attached resolution approving right-of-way abandonment of Mallard Road Route F163 from the State Secondary System of State Highways.

The resolution represents final process in the abandonment of the 0.3 mile southern portion of Mallard Road, Route F163.  The 30 day period to determine if a public desire exists to hold a public hearing opened on August 14, 2018 Spotsylvania County Board of Supervisors Meeting.  The period was open until October 1, 2018. Staff received no opposition for the proposed abandonment. Spotsylvania County Staff and VDOT recommend approval.
Summary:
Planning staff and representatives of the Virginia Department of Transportation (VDOT) conducted inspections of the 0.3 mile southern portion of Mallard Road located in the Berkeley District.  Upon research of the surrounding properties all owned and controlled by the Campers Inn, Jeff Hirsh, CEO, the requestor, demonstrated that this portion of gravel road does not serve benefit to the transportation network of VDOT or Spotsylvania County.   Further, serving only one single property owner, VDOT and Spotsylvania County Staff support the requested Right-Of-Way vacation from the property owner.  A request to determine if a public necessity exists to hold a public hearing for the abandonment of the 0.3 mile southern end portion of Mallard Road, Route F163 went before the Spotsylvania County Board of Supervisors on August 14, 2018. The property owners directly in front of the proposed abandonment were notified that the request period was presented to the Spotsylvania County Board of Supervisors on August 14, 2018.   The property was posted in three locations along the abandonment area on August 16, 2018, through October 1, 2018.  A legal ad was published in the Free Lance Star Newspaper on August 21, 2018, September 4, 2018 and September 18, 2018, finally the legal ad was posted in the Circuit Court and the County Administration building. Seeing no opposition, Spotsylvania County Staff along with Virginia Department of Transportation recommend adoption of the resolution approving the ROW Abandonment. After abandonment of the 0.3 mile southern portion to the cul-de-sac of Route F163, Mallard Road, the applicant will construct a new turn around at the terminus of the new Right-of-Way.
