Agenda Title:
Authorized Agent Resolution for the FFY 2019 Federal Grant Application for Partial Payment of Jail’s Cost to Incarcerate Criminal Aliens 
Recommendation:
The Sheriff and staff recommend that the Board of Supervisors approve the attached resolution in order to apply for federal grant funds under the Federal Fiscal Year (FFY) 2019 State Criminal Alien Assistance Program.
Summary:

The U.S. Department of Justice’s Bureau of Justice Assistance (BJA) administers the State Criminal Alien Assistance Program (SCAAP), in conjunction with the Bureau of Immigration and Customs Enforcement and Citizenship and Immigration Services, Department of Homeland Security.  SCAAP provides federal payments to states and localities that incurred correctional officer salary costs for incarcerating undocumented criminal aliens with at least one felony or two misdemeanor convictions for violations of state or local law, and incarcerated for at least 4 consecutive days during the reporting period.  The reporting period for the FFY 2019 program is from July 1, 2017 through June 30, 2018.

 

There is no local match requirement for the program.   Any grant funds that will be awarded will be passed onto the Rappahannock Regional Jail to offset their correctional officer salaries as directed in the grant. Applications must be submitted by a government official of the state or locality with the legal authority to apply on behalf of the governmental entity.  The Rappahannock Regional Jail is not eligible to apply on its own behalf.  Instead, the County must apply and submit its own data for use of the facility.  The attached resolution will enable several County staff members to apply for the FFY 2019 SCAAP funds.  FFY 2019 SCAAP applications are due by May 23, 2019.
Financial Impact:
There is no financial impact at this time as this is a request to submit a grant application.  If grant funds are awarded, the grant award will be reviewed by Finance, County Attorney’s Office, and Finance Committee before being presented to the Board of Supervisors for their action

Additional Background/Other Considerations:
Starting next year, DOJ plans to add certain immigration–laws-related eligibility requirements to the FY 2020 SCAAP.  Additional certifications by the County Attorney or Commonwealth's Attorney will also need to be submitted with next year’s application.   The Interim County Administrator, County Attorney, Commonwealth's Attorney, Sheriff’s Office, and the Rappahannock Regional Jail have been advised of these new requirements
Consequence of Denial/Inaction:
Denial of the request will mean that Spotsylvania County will lose the ability to recoup some of the Rappahannock Regional Jail correctional officers’ costs associated with incarcerating undocumented criminal aliens
