Summary:
During development of the FY 2020 Budget, Finance staff communicated to the Board that preliminary State budget information indicated that State funding for the Commonwealth’s Attorney’s Office appeared to increase by one FTE the number of Assistant Commonwealth’s Attorney positions funded by the State.  It was noted that if the final State budget were to include funding for the additional position, Mr. Bird requested that the County add a 1.0 FTE Assistant Commonwealth’s Attorney to his complement of employees to help with the workload associated with three attorney positions within his office that are needed based on State staffing standards – one of which was contemplated for funding by the State and two of which remain unfunded by the State.   In a follow-up communication in mid-March, Finance staff reported that the final FY 2020 estimated budget from the Compensation Board – the entity through which the State provides funding for constitutional offices – would not be available until the end of April 2019, well after the Board of Supervisors’ adoption of its budget.  As such, staff recommended that the Board hold off on adding the position to the budget until the final State budget was in hand, as it is now.  In fact, the State did add funding for one additional Assistant Commonwealth’s Attorney, and Mr. Bird is requesting that a 1.0 FTE be added to his budget.   The full cost of the added position including salary and benefits is $115,525 where the State would fund $62,401 and the County would be responsible for the remaining $53,124.  Final budget estimates from the Compensation Board are now available for all constitutional offices.  The increased revenue from these revised estimates (+$244,711) is sufficient to cover the full cost of the added position in the Commonwealth’s Attorney’s Office, with $129,186 remaining.  Consistent with the Board’s action on May 14, 2019, Finance staff recommends reserving this $129,186 remaining balance for use towards implementation of any recommendations the Board desires to move forward with stemming from the forthcoming Compensation Review Working Group report.

Consequence of Denial/Inaction:
The position would be unfunded. If denied, the County would negate the General Assembly’s intent to full staff the Commonwealth’s Attorney’s Office based upon workload.  The General Assembly made an agreement with the Supreme Court of Virginia to fully staff Commonwealth’s Attorney’s offices to meet the new requirements of criminal discovery in Virginia as proposed by the Supreme Court.  Per the workload study, Spotsylvania is due three attorney positions to cover the current workload.  One of the three is receiving State funding for FY 2020.
