Summary:
Authorization to advertise and hold a public hearing on one of the attached ordinances related to Virginia Code § 46.2-844 which enables the County to authorize the Spotsylvania County Public School Division to install and operate a video monitoring system in or on school buses for the purposes of enforcing Virginia Code § 46.2-844 (A). Version 1 of the ordinance requires the civil penalties be payable to the Spotsylvania County Public School Division while Version 2 does not.
Financial Impact:
The financial impact of the authorization is the usual cost of advertisement with the Free-Lance Star.  Regarding the financial impact of the ordinance, if the Board of Supervisors adopts Version 1 of the ordinance, the Spotsylvania County Public School Division has represented that there will be no financial impact to the County as they intend to contract with a company which will pay for the costs of the installation, maintenance, data storage, and monitoring of the video system in exchange for a portion of the civil penalties collected form the enforcement of Virginia Code § 46.2-844 (A).  There will be a cost to law enforcement related to the enforcement of the civil penalty, however the exact amount will depend on several variables including the number of violations.  The Spotsylvania Sheriff’s Office is investigating how to mitigate these costs with the Schools.  If Version 2 of the ordinance is adopted, the Schools would not be able to take advantage of such an arrangement as it would be unable to direct payments to a contractor. Therefore, the Schools/County would be responsible for the costs of purchase, installation and maintenance of the video-monitoring system.
