Summary:
This is the public hearing authorized by the Board of Supervisors (the “Board”) on August 13th to be held in conjunction with the Board’s consideration of the attached ordinance in which the Board authorizes the Spotsylvania County Public School Division to install and operate a video monitoring system in or on school buses for the purposes of enforcing Virginia Code § 46.2-844 (A), and requiring the civil penalties collected as a result of that enforcement be payable to the Spotsylvania County Public School Division.
Financial Impact:
If the Board adopts the ordinance, the Spotsylvania County Public School Division has represented that there will be no financial impact to the County as they intend to contract with a company which will pay for the costs of the installation, maintenance, data storage, and monitoring of the video system in exchange for a portion of the civil penalties collected from the enforcement of Virginia Code § 46.2-844 (A).  There will be a cost to law enforcement related to the enforcement of the civil penalty, however the exact amount will depend on several variables including the number of violations.  The Spotsylvania Sheriff’s Office is investigating how to mitigate these costs with the Schools.

Consequence of Denial/Inaction:
Video monitoring systems could not be lawfully installed or operated on school buses to enforce Virginia Code § 46.2-844 (A).
